WASHINGTON – States cannot ban the sale or rental of ultraviolent video games to children, the Supreme Court ruled Monday, rejecting such limits as a violation of young people's First Amendment rights and leaving it up to parents and the multibillion-dollar gaming industry to decide what kids can buy.

The high court, on a 7-2 vote, threw out California's 2005 law covering games sold or rented to those under 18, calling it an unconstitutional violation of free-speech rights. Writing for the majority, Justice Antonin Scalia, said, "Even where the protection of children is the object, the constitutional limits on governmental action apply."

if anything, it sounds like a bad thing... Most parents are lazy and weak and wont take enough action to ensure their children aren't exposed to inappropriate things. So I support laws that make it slightly more difficult for children to access inappropriate material.

What we need is an R18 rating, not the removal of ratings enforcement.

I disagree. I am generally against government involvement/interference where it is not strictly necessary as discerning individuals should be able to make their own decisions rather than being held to the standards of the government which can often have their roots traced back to religious doctrine. (Plus they tend to completely miss the point, totally balls things up, bury it in red tape and waste far too much taxpayers money doing so). I know there are a lot of stupid people out there but I don't like the fact that the government has to pander to the lowest common denominator to the detriment of everyone else.

The games industry is doing pretty well with its voluntary ratings scheme according to the article. Even if the gov banned sales of mature games to kids, they can easily get them off the internet or just play them at a friends house. there is also nothing to stop them being exposed to similar material through other media such as TV and movies, and a lot of popular musicians put some pretty mature content in their songs and music videos.

For that to be a law it would be done through parliament, The courts wouldn't be involved with this unless a person was being charged/appealing or they were being sued by the government.

Surprised they are so different with video games and other forms of media, the wierdest shit I have ever seen in my entire life would be an M rated anime a friend gave me or what I saw in Lady GaGa's "born this way" clip. I think I saw her give birth to a balloon

Our society does do a lot to 'protect' children, we have a view that kids have the right to a childhood, I think it stunts peoples emotional development. There are societies around these days where people are contributing members of society at 10 years old, but to us that is almost unbelievable. It wasn't that long ago within our own society that the average age of marriage was 12.

Kind of off topic, but I came across some strange censorship last night, I was watching a youtube flick last night that showed some guys top ten moments from The Soprano's.

The scene on the clip was Dr Melfi being attacked and raped in the car park. The guy stopped the scene just before the rape with a message on screen along the lines of "i can't show the rape scene because it is too graphic". Yet the previous scene was Tony savagely beating and strangling to death one of his guys. Somehow rape is worse than murder?

I agree Bageled, sex seems to vilified more than violence in our society, which is strange because sex is a natural biological process, you would think that killing would attract more stigma than sex.

Look at Mass Effect for example, it copped a LOT of flak when it was first released because you could have a relationship with a guy, girl or blue feminine alien. There is a sex scene but its pretty tasteful, (If 'tasteful' can apply to xenophilia) you don't see any nudity.

Then there was the whole 'hot coffee' thing in GTA San Andreas I think it was, where content that was actually cut from the game was unlocked by modders - basically you took a girl home and screwed her in a less tasteful sex scene, but still with no nudity. They wanted the games rating to be changed from Mature to Adults Only because of this, despite the fact that the game basically glorifies violence and gang warfare and other actions that are detrimental to society such as graffiti tagging. If we are trying to protect impressionable young minds then I don't see how a single sex scene, not present in the retail version of the game without hacking/modding, is any worse than any of the other content in the game.

I'm surprised how much crap GTA Sand Andreas got for the hot coffee thing, when your best friends in the video game are drug abusers, thieves, murderers and vandals, somehow the sex scene had to be the worst thing possible in the game? you couldn't even get it unless you hacked the game and I hardly think the young minds they were trying to protect have the ability to actually unlock said content.

I've had 3 versions of San Andreas (1 retail, 2 others copied) and none of them had the Hot Coffee minigame at all, every other person I knew who had the game didn't have it either, leaving the question "dafuq?"

I'm actually very, very surprised at how little controversy Dragon Age 2 has recieved from the media since most people who've played it have said there isn't enough romance options for heterosexuals (particularly males) and yet there are plenty homosexual options. Probably don't want a massive backlash from gays. RPG's today are having quite numerous amounts of sexual encounters with other characters, Mass Effect, Dragon Age, The Witcher (the first I believe had the most sex scenes) and this other one whose name I forgot all have sex scenes.

btw, make sure you dont play RPG's around family, especially when you having sex with a blue alien. awkward :/
