Title: Speeding Fines.
Post by: BoHiCa on 11/06/2015, 07:50 PM
I don't believe they are revenue raising, normally!!!
I just got pinged, first time in over 10 Years....

Penalty notice states on Lloyd Street between Alexanders Ave & Watsons Road Moe.
(Vic 3825)
Now for those that don't know Llyod Street has 4 Speeds 60Km, 50Km, (High Pedestrian Zone), 40Km (School Zone), and 70Km

Where I allegedly got caught is heading west,  where it goes from 60Km to 70Km.
Watsons Road North, Has a 70Km Board approx. 10mtrs, after it.

So who speeds up when they see the new sign? (Yes I did)

I also have been reading this... http://www.camerassavelives.vic.gov.au/resources/30057102-28f5-4bbe-b51c-2cbc7fae6873/mobile-cameras-policy-manual-2013.pdf (http://www.camerassavelives.vic.gov.au/resources/30057102-28f5-4bbe-b51c-2cbc7fae6873/mobile-cameras-policy-manual-2013.pdf)

extracted reading sections I sent my solicitor,

Subject to Special Occasion Sites, every road considered for evaluation as a road safety
camera site MUST fall within one of the following categories:

a) Documented history of serious and major injury collision within the previous
3 years;

b) Subject of a validated complaint of excessive speeds, for example feedback
from general public, local councils etc.;

c) Identified by police to be a speed-related problem site;

d) Alternate speed enforcement by non-camera devices within a specified site
deemed not practicable/unsuitable.

Speed zone signs should not be used to define a site boundary. This will make
it easier for motorists to determine (when referring to the infringement notice) where the
alleged offence occurred.

Where this occurrence is frequent, the site maybe deemed as permanently
unsuitable or in the case of trains, restricted to operate on the opposite side of the roadway
(where the train lines would be behind the speed camera)

I hope you learnt a valuable lesson from that Magic. It might not happen again.

It sounds like part "c" means they can put them almost anywhere they want, however you description makes it sound like it is too close to a speed change, hopefully for you it is deemed to be too close. I'm assuming you got clocked at 70 or under. If you were doing over 70, your argument would be "Yes I was speeding, but I didn't think it was by that much" which wouldn't be helpful.

Write the police a letter saying you have a good boy for the past ten years. You will probably get a warning.
