So I hit the post man in my car (by accident). I was at a give way sign, looked both ways, rolled into the intersection, he rode out infront of my car and I slammed on my breaks and stopped as I hit him.

The police called me 2 or so weeks later for me to come make a statement, I wasnt able to while the lady dealing with it was working as I had work myself. So she called me back once every half hour from 7am-11am until while I was TRYING to get ready to go to work, finally was pissed off enough from the calls that I found the police stations number, called the slut back and tried to organize something, she told me to call her back and she works thursday-sunday. Call back on Thursday, shes not even there, I ask the guy if he could let her know I called for her, he sent her an email letting her know.

1 week later, still no call. But Ive received a speeding fine aswell.
My issue is once I take that point for speeding, I will have accumulated 4 points which would be my license lost. I would jump on the 1 point for a year thing, but because I have no flying clue whats going on with the police at the moment if I took the 1 point for a year and then got 3 points for "failing to give way" (even though I gave way and the postie just had a death wish), then Id lose my license for 6 months.

What is suggested to do braahs?

ask someone who loves you to take the hit. You pay the fine they lose the points. You fill out a form saying that they were driving at the time of the offence, assuming it was a speed camera. Otherwise, sell your car, buy a pushbike and hope karma doesn't get you run over.

You're better off taking the 3 months suspension. Nearly everyone I know that did the 1 point thing lost it in a few months then had to take a 6 month suspension. Doesn't matter how careful you are, something stupid will happen.


Ultimately you need to speak to someone qualifed in legal matters and traffic law, not just randoms on the internet. From my experience you're pretty boned though, you won't get out of it without a suspension. The notice of suspension usually takes a good 3 months to arrive too, so just when you thought they'd forgotten about you, it shows up in the mail.

I had a 3 month suspension a few years ago for speeding on my bike (120 in an 80 zone) and it wasn't so bad. I got a lift with a co-worker and it was over quickly.

Cycling to work isn't so bad. I've started cycling to work and home on sunny days, ~55km round trip. Its a bit sad in the rain though

mammi talk to me in TS i have seen enough of these with mates and have done myself (163 in a 100 Woops)

if the issue with giving way is decided after the suspension starts it wont affect the suspension as it was an incident prior

but as donut said take the 3 months as its alot easier and afterwards you get all your points back Smiley and with the 12 month it can be any cop on a power trip and your fucked - probably doable in your car if its roadworthy if you dont drive stupid or speed

Possibly get a statement from neighbors saying that the posties in the area are always zigzagging.  In your statement to police say you stopped, he came out of nowhere (if its a blind corner ie bushes & fences ) take pictures.

State that he was possibly looking at his run sheet because you can't fathom why he would just run out in front of you snd that as he was on the footpath and not on the road and it was not at a pedestrian crossing he was possibly breaking the law by riding a registered vehicle (thus the license plate) on the footpath.

As he was acting in the manner of a pedestrian or a bicycle on a footpath you had right of way,, especially as you did come to a complete stop and look in both directions...a pedestrian would actually have to give way to you.

Regarding the speeding fine...you're fucked!

As Bageled says get some one with more points i.e. not on P's to take the hit, but if you take the 3 month suspension you will have 4 points after rather than one. I coped the 3 months suspension drove like an old lady for the period, still try to and still had 12 points several years later when Bageled who was originaly the carefull driver needed some spare points to avoid losing his licence. bit risky on P's though
But word of advice, your car will not get you there much faster if you speed than if you don't , and is your time really worth $3000.00 an hour to get there 5 min earlier.

The road I was speeding on is a hard one to do 60 along, its a straight main road thats quite wide. Still no excuse I know, but Im a frustrated teenage P plater, leave me alone ;p

In regards to the postman incident, he wasnt on the foot path, he was on the road and I couldnt see very well around the right of me due to 2 4 wheel drives parked on the side and a tree and a fence and a power box. Harley and his brother were in the car at the time and they were the only people who actually saw the accident. Some random dickhead stuck around though who had his back to the accident the whole time but apparently he was going to make a statement. All the AUS post guys were dicks too, and went off bitching about me saying I was retarded and how didnt I see him because he looked like "big bird on a bike".
He zipped out onto the road, with headphones in (so he probably didnt hear me) and didnt even know I was there until he was in front of my car. Im gathering Ill get the blame though -.-"

Has anyone had any experience with work licenses? I live a good 40 minutes from my work and the public transport is limited in my area. Ill also lose my job (be put into financial hardship) over the Christmas period as Ive been taught how to open and close the store for the busy period of the year.

my suggestion, find the postie you hit and offer him a blowie to make the whole thing go away, I mean why should a loved one take a hit for your when all you got to do is spit and make it ok.

You can't get a work licence on your p's. need a full licence for that and you have to take or to court and ask the magistrate. They don't just give them out.



I've seen some posties do pretty stupid things, it's obvious they haven't done any defensive rider training. As a rider myself i know how easy it is to Not be seen By cars (bikes often perfectly hide behind the pillars as the driver creeps forward, high vis Dont help there) and you have to take it upon yourself to avoid danger where you can. Regardless it's your word vs. the posties and you're on your p's so you're fucked.

I don't know if you can do the 1 point thing if you're on your P's but if you do try to avoid driving as much as you can. To work and back and urgent errands only. Qld cops are cunts, they will pick on you and they can ticket you for basically anything even without evidence. The state pushes them to issue tickets to raise revenue. They are nowhere near as bad in nsw.
